General Terms and Conditions (GTC)
1. Scope
These terms and conditions apply to all orders placed through our online shop as well as to all deliveries and services provided by:

By placing an order, the customer accepts these terms and conditions.
2. Conclusion of the contract
All images in the online shop are non-binding.
A legally binding contract only comes into effect when:
– the order is completed (order subject to payment),
and
– an order confirmation was sent to the specified email address.
SAQAP reserves the right to refuse orders without giving reasons (e.g., in case of incorrect information, suspicion of fraud or payment default).
Changes are only valid if they have been confirmed in writing.
3. Prices & Payment
All prices are final prices in EUR.
Due to the small business regulation according to § 6 para. 1 no. 27 UStG, no VAT is shown .
Payment methods:
– Credit card
– Klarna Instant
– EPS Online Banking
– Apple Pay
PayPal
The goods remain the property of SAQAP until full payment is received.
If the customer defaults on payment, we reserve the right to:
– Default interest will be charged at the statutory rate,
and
– to suspend further deliveries.
4. Delivery & Shipping
Delivery will be made to the address provided by the customer.
Delivery times are non-binding.
If a delivery cannot be made due to these points, the customer will bear the costs:
– Refusal of acceptance
– Package was not picked up
– incorrect delivery address
– missing name on doorbell/mailbox
A redelivery will only take place after the shipping costs have been paid again .
The risk transfers upon handover to the shipping service provider.
5. Revocation
The statutory cancellation period of 14 days from receipt of the goods applies.
Details can be found under "Cancellation Policy".
6. Return Policy & Refund
The goods will be inspected after being returned.
A full refund is only possible if the goods:
– unworn, used in everyday life
– clean, hygienically flawless
– not washed
– without odors (perfume, smoke, sweat)
– without stains/makeup
– with all labels and tags
– in original condition
will be returned.
In case of diminished value, a deduction of up to 100% may be made if the goods are not resalable.
The buyer bears the return shipping costs.
7. Exclusions from the right of withdrawal
There is no right of withdrawal in the following cases:
– personalized products
– individually customized goods
– Items without original labels
– Items that are returned significantly soiled/used
– Items with clear signs of wear
8. Warranty & Defect Reporting
Austrian law applies.
The customer must report defects immediately in writing.
Warranty claims do not apply to:
– incorrect washing application
– Wear and tear from use
– Alteration of the goods (washing, cutting, dyeing)
– Damage caused by improper use
SAQAP has the right to:
– Repair
- Exchange
or
– Refund with value deduction
within a reasonable timeframe.
9. Liability
Liability is only accepted for damages caused intentionally or through gross negligence.
The following are excluded:
– Delivery delay
– financial losses due to delivery delays
– Consequential damages
– Loss of use
Legally mandatory claims under the Consumer Protection Act (KSchG) are not excluded.
10. Copyrights
All designs, photos, texts and product graphics are the property of SAQAP.
Use without permission is prohibited.
The following are specifically prohibited:
– Reproduction
– Publication
– commercial use
– Logo usage
This may lead to claims for damages.
11. Jurisdiction & Choice of Law
Austrian law applies exclusively.
The place of jurisdiction – insofar as legally permissible – is: Innsbruck, Austria .
The contract language is German.
